The office

The notary as a person of public trust

A notary is appointed to perform acts that the parties are required, or wish, to have notarised. A notarial deed and other documents drawn up by a notary in accordance with the law have the status of official documents. The office of notary Agata Dambek is located in Gdańsk, in the heart of the Old Town (Główne Miasto) on ul. Chlebnicka. Notarial acts are performed in Polish.

A note for international clients

Poland follows the Latin (civil-law) notarial system, so the role of a notary here is wider than in common-law countries. A Polish notary (notariusz) is a public official who, rather than mainly witnessing signatures as a notary public does in England, Wales or the United States, draws up authentic instruments — notarial deeds — that carry full legal effect, and acts impartially in the interest of all parties. Matters are governed by Polish law (the Law on Notaries), not by English or U.S. law, and the scope and required form of individual transactions may therefore differ. Separation of property, extension or limitation of statutory joint property, and division of joint property.

Wills

Drawing up wills, and the revocation or amendment of testamentary dispositions.

Deeds certifying inheritance

Notarial confirmation of the acquisition of an estate after a deceased person.

vi.

Powers of attorney

General, specific-type and single-act powers of attorney.

vii.

Limited property rights

Mortgage, easements, usufruct and other encumbrances on real estate.

viii.

Certifications

Certifying the authenticity of a signature, the conformity of a copy with the original, and the date.

ix.

Minutes of meetings

Minutes of company meetings and meetings of housing communities.

x.

Formation deeds of companies and foundations

Articles and statutes of companies and foundations, and their amendments.

xi.

Notarial deposits

Accepting money, documents and data for safekeeping.

xii.

Copies, extracts and abstracts

Issuing certified copies, extracts and abstracts of notarial deeds.
